1. What types of absences affect my attendance rate?
Any absence that are not protected by State of Federal law can negatively affect your attendance rate. An example of this would be unprotected illness time.
2. What are Protected Absences?
Protected Absences are absences that fall under the protections of State and Federal laws. These include, but are not limited to:
   -Pregnancy Disability
   -Family Medical Leave Act (FMLA)/California Family Rights Act(CFRA) absences (which include serious health condition of the employee or employee’s qualified family member, or child bonding)
   -Kin Care
   -Military Leaves
   -Jury Duty
3. Is Personal Necessity time protected?
Personal Necessity is an unprotected absence. However, an employee can use FMLA-protected personal necessity time in cases of caring for a family member* who has a serious health condition, or with the birth of child, adoption of, or the foster placement in the employee's home (child bonding).
 
* A family member is defined as a parent, spouse, child under the age of 18, an adult dependent child incapable of self-care due to a mental or physical disability, or a registered domestic partner.
4. Do days off taken for Religious Holidays count against my attendance rate?
Religious Holidays of one's faith are allowed under most of the collective bargaining agreements, by Personnel Commission Rules for unrepresented employees, and by the Education Code. Therefore, these holidays do not result in any adverse action regarding an employee. However, these absences, like other Personal Necessity Absences, do count against achievement of Performance Meter goals.
5. Are Worker's Compensation absences protected?
If the workers' compensation injury is also an FMLA-qualifying serious medical condition, then the absences related to the injury can be protected for up to 12 work weeks. After the 12 work weeks, workers' compensation absences are unprotected.
6. How do we code FMLA-protected Workers' Compensation time?
The two time codes for FMLA-protected Workers' Compensation time are as follows:
   -FWC
   -FWA (School Police only)
7. What categories should an Administrator focus on when trying to improve employee attendance?
An Administrator should focus on the areas where the most unprotected time is used. This is usually unprotected illness time.

9. When is the attendance data available?
Attendance data runs about a month behind, because of payroll cycles and adjustments. Data for the previous month is usually available on or about the 21st of the current month.
